I married an illegal immigrant 2yrs ago and am now wanting to know the process for fixing his papers. Here is a background of the situation.
My husband came here on a tourist visa on 5/5/01. He was supposed to leave 6mths after but never did. He remained here and started working.
Now that we are married and we're saving money for the process, I need to know what forms I need to submit? Lawyers cost too much, its already hard enough to come up with the money just for the forms, much less pay someone to prepare them for me.
Anyway, as a result of my research I have found that I need to file the I-130 first and foremost. Then I can, or i dont have to, wait to file the I-485, (with filing the 485 I must provide copies of my birth certificate, One passport style photo, the marriage certificate, and for my husband, his Birth certificate (translated), a copy of passport page with nonimmigrant visa, a copy of his I-94, 3 passport style photos, a medical examination (form I-693), and lastly, our latest income tax return & our W2's.
Somewhere in the process I need to file the I-765?
My last question, after filing the I-130 will that get us his green card? or is it only after filing all forms? Also, he has a taxID for when we file our taxes, is this considered his Social Security number on those forms or do we ever use his taxID when filing these forms?
WoW, if getting married to a US Citizen is the fast lane to getting a green card, I HATE to see the slow lane!!! I appreciate any feedback for my questions.
