    Default Selling to a Minor

    My question involves criminal law for the state of: Illinois

    When does the actually sale of alcohol to a minor become valid? If an employee asks a person for a customers I.D. but doesn't necessarily catch that they are underage until after the item is rang up can one void the transaction and give the person their money back without being charged with distributing to a minor? Also if the individual is an undercover operative who leaves during the sale but leaves the alcohol behind, how is that consider selling to a minor when they left the product? Lastly does signing a citation mean that you plead guilty to the crime you were accused of?

    Possibly - however, it can be very dependent on the exact circumstances and how well the arresting officer can articulate that the elements of the crime were met. Suddenly realizing that you committed a crime and then successfully trying to take it back doesn't mean it wasn't committed.

    Because once the transaction is complete, the item legally belongs to the customer after the sale. The clerk can be charged for that exchange whether the buyer takes the item, leaves the item, drinks the item, gives it to someone else, or tosses the item in the trash.


    Lastly does signing a citation mean that you plead guilty to the crime you were accused of?

    No, it means you received the citation. You'll plead guilty or not guilty in court in front of a judge.

    The minute the cash register went "cha ching" you were already in trouble.
