    Default How to Expunge a Felony in West Virginia

    My question involves expungements or pardons for the state of: West Virginia. I was convicted in 2008 of distribution of a controlled substance.(marijuana). I was wondering I could do anything to have the record sealed or expunged. Also, could I get the right to vote and gun rights back?

    From what I can see, to get an expungement after conviction you will need to first get an unconditional pardon and then wait at least two years to petition for an expungement. Pardons are difficult to get, and generally require substantial evidence that you've reformed. For the statutes, read this thread.
