    Default Deferred Adjudication

    I am very worried. I was caught shoplifting at a retail store in Texas and the worth of the item was under $50. I was not arrested however I got a ticket. I hired a lawyer who convinced me to accept deferred adjudication. I was assured that this incident would not show up on my employer background check since I was never arrested. Is this true? Does not getting arrested make a differece?


    Also, is there any way for me to check my records to either make sure there is nothing there, or, if my shoplifting mistake shows up, not accept the job offer that I just got?
    I've just graduated from college and I am worried sick that this one mistake will follow me forever.

    You can check your Texas state criminal record online, through the Texas Department of Public Safety website. There is a fee for that service.

    If you successfully complete a deferment you shouldn't have a conviction from the charge. Also, if you were issued a ticket and not arrested, you shouldn't have an arrest on your record. You may still have an indication of the charge - I am not personally acquainted with what goes onto a Texas criminal record, but here in Michigan they show the initial charge along with the disposition.

    This was a Class C misdemeanor charge? If so, and it appears on your record, you should be able to petition the sentencing court to expunge your record if you were sentenced in JP Court or Municipal Court, or otherwise seal your record.

    Dear aaron,

    I registered with the website you posted and I did a criminal history search with my name and DOB but nothing turned up. Does this mean that an employer background check will not reveal my citation?
    I asked a lawyer and he said that I dont need an expunction because I dont have a criminal record to expunge, yet I am still worried because I read online that texas still considers deferred adjudication as a conviction and as such, it will still show up on a person's criminal background check. Is this website a good litmus test of what my potential employers will see when they run a background check on me?
    I realy need help because I am completely confused.

    A Texas lawyer is in a much better position than I am to answer your questions. I don't have a sufficient basis in Texas law or procedure to second-guess the lawyer you consulted.

    You can use a commercial service like [url=http://www.knowx.com/]KnowX[url]. You can use the fee-based Pennsylvania State Police service for a Pennsylvania criminal record. The easiest way to get an Ohio criminal record check through a state office appears to be through a County Sheriff's Office.

    What is the best way to see what potential employers will see on my record? The Texas Department of Public Safety website does not show anything when I run a check on myself but I dont know if I can trust this or not.

    The best way would be to find out exactly how any given potential employer researches your background, and use that same method. Can you realistically do that? Probably not.
