    Default Utilities Increase

    Hello, I live in San Francisco, California. I want to know whether or not my landlord can make me pay the utilities increase.

    When I first signed the lease, the agreement states that "Landlord shall pay all the cost of the total utilities charges that included electric and gas, water & garbage related to his occupancy of the premises."

    However, the term was only for one year (2007-2008). After that I just pay my landlord the same monthly fee without paperworks.

    Recently, my landlord sent me an annual rent adjustment increase letter and part of it states that "the utilities increases increase in the amount of $59.00 is based on the comparison of the usage increase in between 2007 and 2009 for your unit shares (4/11)."

    Can my landlord make me pay the utilities comparison increase?

    Are you telling us that you've been a month-to-month tenant since the lease expired back in 2008?
