    Default I Cant Get a Job Because of a Record - What Do I Do

    My question involves criminal law for the state of: NY.

    I committed 2 misdemeanors, one in 1995 and the other in 1999. They had to do with phone harassment. Since then, I graduated from business school with honors and received a Bachelors in Business.

    When I apply for jobs in finance, I'm turned away because of my misdemeanor record that shows up in the background check.

    I had gotten a Certificate of Relief from Disabilities. But, this does NOTHING to help me get a job. I dont know what else to do. I need to work! What do I do? I'm desperate!

    You keep applying for jobs until you find an employer willing to overlook your record.

    There's no legal question here.

    There are lots and lots and lots of people who need work, and many of them have degrees, and many of them have no criminal record, and many of them have degrees and no criminal record.

    You can't force an employer to hire you. Any more than all those other people can.

    Could you start your own business? Take up volunteer work that shows you have learned from your mistakes? Maybe finance-related jobs hold particularly
    stringent requirements for background checks? Maybe you could branch out a bit? Good luck and hang in there.

    So what's special about you, that out of the 50 qualified people I have applying for the job, 45 of whom do not have criminal records and all of whom need a job just as badly as you do, that I should hire you instead of one of them?

    The EEOC at http://www.eeoc.gov has established guidelines for employers
    to deal fairly with job-seekers who have criminal records. You might want to read that information. Many employers only look back seven years. You'll find someone willing to give you a chance! It's great you graduated with honors. You have what it takes to succeed. For most federal jobs you get a chance to explain any black marks on your record, and you can appeal if they turn down your background check. Don't think they'd take much chance on people who've been jailed over a year though.

    Myself feel discriminated against, and due to complaints about that my employer decided to lodge false,retaliatory criminal charges against me to protect themselves from liability. Talk about an unfair, discriminatory world! To have one's fingerprints on file with the FBI is a pretty bad job reference. Plus, this database is half wrong and doesn't get updated in a timely way.
