Default L2 EAD to Green Card

    Hi,

I am L1 A and my wife is on L2 and recently received her EAD. My question is:
Can she apply for AOS (I-485) directly or does she need to have an I-480 approved first before going for I-485. If so how long would it take, coz my L1 A will be expiring in 2012 Aug and I will have to travel back.

    Thanks,

Her L2 status is dependent upon your L1 status. If you go out of status, so does she. She should look into alternatives that might allow her to remain in the U.S., such as H1B (if she qualifies); presumably you hope to stay as well?
