My question involves criminal law for the state of: Virginia
Alright so I got caught with marijuana and have a summons to appear in court. I live in Richmond, VA which is a decent size city compared to the others in VA. I have heard they get a lot of these cases so they are pretty quick with it and I will probably get my "punishment" (for lack of the correct term ATM) on my first court date. I know I CAN get up to jail time fine, CS, license suspended, but the officer said ususally for first time offenses I will get 50 hours of community service.
The problem for me is I have been charged with underage possession of alchol. It was last year (2009), and I had to do 50 hours of community service, and once it was complete it was removed from my record. (I did the community service and it should have been removed, don't know for sure though)
My question is will this effect the Judge's decision on my "punishment"? It was in a different city/county and it should be off my record. Also since this is a different charge then the other one is it still considered my first offense under possession of Marijuana?
Any help would be great. Yes I know that all Judges and courts and cases are different so it very well could be different.
