    Default Caught Shoplifting at Wal-Mart in California

    My question involves criminal law for the state of: California...
    So here is the story...I dont know what to do or whats gonna happen so im trying to find out cause im SCARED...
    Saturday I was at walmart and got caught stealing a load of camping equipment...I got out the door and a guy stopped me...he took me into a room with another guy and then they had to get a female in there also...well anyways it was just the loss prevention guys and a door greeter...the loss prevention guy was rude and wouldnt even let me talk and told me if I talked he was going to call and have the police show up....he asked for my id and I told him I didnt have it on me...so he called someone and looked up my info by my name and date of birth...not sure who he called...well they totalled up t he items and it came to 199.00....he said he was banning me from walmart and all walmart assocaited stores...I signed the paperwork..which they gave to me and they didnt even keep a copy of it...I also got paperwork saying that I will have to pay a fine to walmart no less then 50 bucks and no more then 500.00 bucks....and I can call them early before I get the paperwork in the mail so I can pay the fine...I also filled out paperwork with my name address, phone number, social security number and took my finger print...I signed it...they said I will be getting a letter in the mail with a court date and what not...if I dont show up there will be a warrent for my arrest..I am going to pay the fine as soon as I find out how much it is and I will for sure go to the court date and plead no contest ( I think) but my thing is, no cops showed up at the walmart so whats gonna happen...and I have never ever been in trouble with the law before so....can someone help me out and tell me whats gonna happen...for something petty like this, I shouldnt have to do any jail time right...and how will I get a petty theft off my record? any info will help

    Sounds to me like they are sending the info to the police and DA. Yes, you will need to appear in court.

    If you can't afford a lawyer, plea NOT GUILTY and ask for a public defender.

    You also need to pay the Civil Demand - aka, the stores fine.

    You need to stay out WalMart AND Sam's Club also.

    What will likely happen is after court, you will be given fines. You will have a record, unless you can get a lawyer to get your charge dismissed (not likely). A reduced charge is possible.

    And you may have to go to the police station for fingerprinting and mugshot.

    im going to pay the fine as soon as I get the amount..I called this morning to get it but it hasnt been put into the system yet.....I will also not be going back to walmart or sams club.....the loss prevention guy said I can talk to the court about doing some class to get it off my record...does that sound right??? this is my first and only offense...are you sure it will go on my record?
    I will go into there and say I am not guilty and had no intent in taking the items...
    but if they ask well how come you walked out the door with the items...then what do I say?

    You just plead Not Guilty, then ask for a public defender.

    The PD may be able to get your charge reduced, or you into a program that once completed, means the charge is dismissed.

    why should it go criminal anyways? its just a civial case, but if it goes to court then its criminal??

    Why would it go criminal? Because shoplifting is a criminal act.

    they said I will be getting a letter in the mail with a court date and what not...if I dont show up there will be a warrent for my arrest. Besides court, expect to have to make a visit to your local cop shop for fingerprinting and mugshot.

    The Civil Demand is separate and still needs to be paid.
