My question involves criminal law for the state of: Montana. I was in my dorm room with some friends after a party. Our RA tried to push open our door and my girl friend shut it because she was changing. He claims he saw a beer, which turned out to be an energy drink. We did not let the cops come in our room but they claimed they smelled alcohol, from the previous party. So we were all breathalyzed and issued MIPs. Did they have and probable cause to come to our room in the first place? Also someone blew a .027 and the officer wrote .115 down on the ticket. Should we contest the charges, or pay the fines and go on our way?
