    Default Roommates Rejecting All Replacements

    My question involves a roommate in the State of: New York

    The apartment is in New York City. I have been trying to get out of my lease since January 2010. The lease is over in November. I have 2 roommates and we are all on the lease. My roommates have rejected all, except one who later backed out, of my potential replacements claiming that the new roommate must meet all the criteria that we did when we moved in. I have had approximately 60 responses to my ads that have been posted for 4 months. I have asked to have someone just for the summer, to relieve me of the rent for a few months, and been turned down. I have been living with my fiancee for the past 4 months, and have not used my room.

    Do my roommates have a duty to mitigate?
    Am I still responsible for utilities? When I brought up the issue of utlities I received an angry email from one roommate, threatening to take me to court if I don't continue to pay 1/3 of utilities.

    You are responsible for whatever you agreed with your roommates. If they believe that means you have to pay 1/3 of utilities even after you move out, and you do not, they can sue you and ask a court to decide.

    You would certainly want to present the defense that they unreasonably rejected one or more proposed alternate roommates, so make sure everything is well-documented and that you keep the documents.
