    Default Terminating Parental Rights for Child Abandonement

    My question involves guardianship in the State of: NJ

    Okay I need some help... I have a 2 year old and his father has not been in his life since he was a little baby and barely saw him then its been over a year since his last contact with my son and i wanted to know how I can go about terminating his rights so that my new husband (whom is in the air force) can adopt him... my childs father has 3 kids with 3 different women and owes all of them child support, not to mention we broke up becuase he hit me (did 5 days in jail for it). Wanted to know what my options are?

    Another issue to add to it...

    I joined the air force (national guard) and gave my mother guardianship of my son while I was away, she still has him under her roof.... not sure if that affects any the the above either? Appreciate any help!

    Are there any court orders for child support/visitation?

    You need an attorney to help you with TPR/stepparent adoption in any case. It's not a DIY project.

    Were you married to the father? If not, how was paternity established? Was paternity established?

    if he is not the legal father, he cannot be seen as abandoning his child.

    In addition to the fine advice of Doggie and JK, you won't be able to proceed with anything until you file to have your mother's guardianship rescinded.

    The father and I were never married he signed the birth certificate.....

    there are no court orders as of now for visitation/ CS... we had one bc I was getting aide through the state and they went after him for back CS the county told me bc im off the benefits I would have to file a new docket inthe court

    If he is paying child support - even to the state - that is considered contact.

    he may very well be paying support to the state still.

    i was only on state aide for about 2 months, it stopped in 2008 and the county got the money back from his tax refund

    When?

    Which tax refund?

    Have you ASKED him if he would agree to the adoption... that is much easier.

    hiring a lawyer would be the most prudent action.

    it seems 6 months is adequate time to be considered abandoned. I could not find any forms or specific guidance on the process. Here is a link to s site. I perused the site and did not see anything for your needs but I did not read it all that thoroughly.
