My question involves criminal law for the state of: New York
I am 19 years old and I was caught shoplifting from whole foods in Chelsea. The total retail value of items was $79.85. I was detained in the security office. They took my photo, copied my license, and I signed a trespassing form saying I was banned from the store.
This is my first offense, I have never been arrested in my life. The cops came, cuffed me, printed me, took my picture, and gave me a desk appearance ticket. I have a court date in a month. I am being charged with petit larceny Code 165.40.
This happened to my boyfriend last year. Same store, his item was $70. He got community service and paid court fees of $120. I'm not sure if he was granted an ACD but it was also his first offense.
Should I get an ACD? I Read up on it and it sounds like I will need it. I am a photography major and wondering how this will affect my life. I haven't told my parents yet, I am terrified of what they are going to say and do. I am not sure if I can afford a lawyer but they are in touch with one.
Please help me.
