    Default Company Being Sold - Should I Resign

    My question involves labor and employment law for the state of: Michigan

    The division I work for in this S company is being sold to a Fortune 500 company as opposed to being shut down. My colleagues and I have been asked to resign with a letter of resignation before the transfer takes place.

    Should we?

    We have been given a letter that states that:

    "Thirty days after the sale closes we will no longer have a position for you. It is our understanding that you will be offered a position to work for the new company starting June 1 2010. If you choose to accept their offer, we will expect a letter of resignation from you."

    I'm not seeing any upside to you resigning. In fact, the downside is that you would most likely NOT get unemployment benefits.

    Thanks for your reply PattyPA, that's the way I see it too.

    We have complained to the current employer and they are changing it so there is no requirement to resign, the position will become redundant. Happy happy joy joy...

    I see nothing wrong with you signing a letter of resignation under these specific circumstances, meaning you first receive and accept an offer from the new company. That is pretty much the same as if a totally different company gives you an offer which you accept. -- If, of course, contrary to the words in the letter that you have quoted, they expect you to resign FIRST, I would not do that under almost any circumstances. So, it depends on if they are going by the letter that you quote or the statement that you made before that.

    from what I see, the letter is expected only if you accept the job offer from the other company. So, you get a new job with the new company and you give a letter of resignation to the company. Done deal.
