Roommate #1 has caused a lot of problems. He has not paid rent on time, suspected of breaking items in the apartment, possible drugs, causes problems with neighbors. Can I evict this roommate on these grounds?
Roommate #2 cannot stand roommate #1 and wants to end the lease. They both have 10months left on the lease.
Lease says the following:
If the lease is ended, rent and added rent for the unexpired Term becomes due and payable. Landlord may re-rent the Apt. Landlord may rerent for a lower rate and give allowance to the new Tenant. Tenant shall be responsible for Landlord's cost of rerenting (repairs, attorney fees, advertising). Tenant shall continue to be responsible for rent, expenses, damages. Tenant waives all rights to return to Apt after possession is given to the Landlord by Court.
What actions should I take with Roommate #1 & #2? Do I need to take 2 separate legal actions?
