    Default Seizure of Property

    West Virginia


    can the bcse in WV seize property in Ohio for back child support?
    How long does this take?
    Can they seize it if there's already a contract for purchase that is 2 years old between the owner and their purchaser?
    When the papers are served is there any way to stop this from happening?

    I have received notice that the BCSE has issued a request for seizure of my property for owing 3500.00 in arrears for child support. 2 years ago I went into a contract with a potential buyer of my house , will the seizure make this contract null and void or will the seizure of the house still be in effect?

    You mean, can you escape the contract you entered two years ago because you failed to pay your child support resulting in this new order? No. The buyer would have to release you and, if you breach, you can be held liable for the breach. I don't know the details of this contract for sale, but if you end up with a lien based upon your arrearage there's potential for the child support to be paid from your share of the escrow.

    I am not trying to "escape" the contract that I entered into nor am I trying to get out of paying my child support arrears. I am perfectly fine with ending up with a lien to pay off before sale of the property is final. The contract states that the person who will be purchasing the house had two years of a land lease with purchase at the end of it. I am working on paying my back child support and honoring my contract with my house. I just needed to know if the state requesting seizure of my home is going to void the contract. Neither of which I want.

    Also, the mortgage for the property is in both my and my husbands name, does this effect it as well as he's not the obligor in the child support case.
