    Default Domestic Battery, Threatening a Public Servant and Resisting Arrest

    My question involves criminal law for the state of: Florida

    I am sick with worry! Husband was arrested for having a serious case of the drunks, and was charged with Domestic Battery, Threatening a Public Service Officer & Resisting Arrest without Violence. I never gave a statement, nor am I pressing charges.

    I was told by the officer that these were misdemeanors, is that true? I can't verify. Is it possible to avoid jail? He was drunk & disorderly and doesn't remember a thing.

    I am so stressed, if anyone can shed any light or input, I'd really appreciate it.

    You don't need to. However the incident came to the attention of the police, the state can bring criminal charges when they have reason to believe that one or more crimes was committed. (Think of it this way: if they had to have victims willing to press charges, no murder case would ever be pursued because dead victims can't press charges).

    Yes, each of these charges in Florida is typically a misdemeanor, meaning maximum punishment of up to one year in jail for each charge, although most of the time even multiple convictions will run concurrently.

    Possible, sure. Probable? Depends on a lot of things, such as any prior criminal history, whether there were any injuries inflicted, whether he's willing to COMPLETE treatment for alcohol abuse, anger management, or domestic violence, or some combination of these, to the court's satisfaction, and whether or not the prosecutor feels they've got a slam dunk case (remember, prosecutors get paid to prosecute, not drop, cases) or whether they're willing to plead to lesser charges to get the case over with.

    Thanks so much for the response Aardvarc. It is difficult to find accurate information online, as every case is different. I'm looking for the light at the end of the tunnel, this makes me feel a bit better.

    He is more than willing to complete alcohol treatment, this is really what he needs and where the problem stems from.
