    Default Notice of Writ and 30 Days Sent Certified Letter

    I live in Virginia and own house about an hour from where I live. I sent a notice of writ and a notice of 30 day to vacate premise to a family that owed over $7,000 on March 1, 2010 certified mail. I have not heard from the family since Feb 1, 2010. I had the power shut off at the house as of April 10, 2010, thinking they were trying to avoid the court notice.

    I got a call today from the power company that the tenants had not vacated and they were trying to get the power turned back on! My concern now is that I have not received the green card back from the certified mail service. If they did not get my letter of writ or 30 day notice that I sent certified mail almost six weeks ago, do I legally have to turn the power back on and then serve them all over again.

    What is the legal responsibility on my part? If I sent a certified letter and they did not receive it, does the law consider me sending it and thus being able follow through with the eviction?

    You did keep a copy of the letter, date mailed, and postal receipt, right?

    You would need to obtain a final order through the court in the county in which the home is located.
