    Default First DWI in New York and No-Show at Court

    My son was arrested and charged with DWI in New York last month - he's 19 years old. His top charge is as follows:

    VTL 1192.2 02
    Unclassified Misdemeanor
    Description Oper Mv .08 Of 1% Alcohol-1st

    When he was arrested, he also received 7-10 traffic violation summonses.

    He was released on his own recognizance and was due back in Court today. I am 99% sure that he did not go to Court today, so my question is... what is going to happen?

    Your son will be issued a warrant for his arrest. He will either get cought sooner or later by the police and they will know he has a warrant or maybe a bounty hunter will try to get him. I'm not sure how much time must pass before they give your son's name to bounty hunter IF they even will. You best option would be to contact a lawyer, tell him what had happened, after you hired a lawyer take you his advice and probably have your son turn himself in and have the lawyer represent him. Maybe just maybe a lawyer can bypass warrant and schedule a court date or a hearing quickly so your son doesn't have to turn himself in but I'm not sure how that works so contacting a lawyer would be your best option also. However, to answer your question I know for that court will issue a warrant for your son's arrest for a No-Show at Court.

    I forgot to add that if you son has a lawyer and the lawyer showed up to his court date then your son may be OK. In some cases lawyer by himself can represent the offender in court. This would depend on the state and the type of offence. Again, contact lawyer to find out for sure, I can just give you advice from my friends and relatives experiences with courts. I live in IL, NY precedures may be different.

    Thanks very much for your response. As it turns out, my son went to Court this morning with his lawyer, so hopefully things will get worked out... hopefully. Thanks again.
