    Default Probation and Sentencing in Florida

    My question involves criminal law for the state of: Fl. My husband has a long wrap sheet from grand theft, petty theft, vop, and spent 2 years in prison for those crimes. Two years ago he received probation and restitution for possession of cocaine. He had 1 and half months to go when he got rearrested for the same crime. His probation officer also added curfew, possession,out of county, in a bar, and monies owed. I paid the monies owed for probation and we are waiting for him to get transferred to the county he is on probation in. He was arrested in a different county and is still in jail awaiting sentencing. Can you tell me what sentence is he looking at for the vop and will his past effect it? Also will him being on probation effect the sentencing in the county he is at now?

    Yes, his past will impact new sentencing. Judges really start getting tired of seeing the same people over and over - especially for the same crimes. His probation could be revoked, and future probation or parole will stop being offered. He's looking at up to a year for each VOP, plus imposition of whatever was remaining on his original sentences.
