    Default Currently in Chapter 13 and Moving to Canada

    My question in the State of: NY

    I am current in a 12 month of a 60-month 100% Chapter 13 payment plan. I am current with my plans. My wife and I are planning to move to Canada for good. We will not come back to the US to live anymore. Maybe to visit, but not to live. We were not born in the US but overseas and we have been living here for the past 15 years. Now, if we move to Canada for good, how does it work with chapter 13? We are moving to Canada but we do not have a job in line yet. We will move that look for a job once we get there. How does that work with the plan? How will provide the trustee with a disposable income if we will not have a job there yet?

    If you want to maintain your Chapter 13 plan, you will continue to make payments. If you default on your plan the case will be dismissed. If you voluntarily quit your jobs such that you have no income, don't expect the trustee to have much sympathy.
