    Default How to Evict a Roommate

    My question involves an eviction in the state of: New Jersey

    Hi,

    I have a roommate who wont pay rent and wont leave, now he also have a girlfriend who has started living with him in the room. When i rented him the room i made him sign a very simple lease that just mentions that he has to pay rent monthly. The lease did not mention anything about the utilities and and anything else, but we verbally agreed that we split the utilities and internet.
    I don't want to go to court because i am scared that it will show up on my record that i had filed an eviction proceeding. Since he has not paid me any utilities bill and the money for the internet and is still refusing to pay, I was wondering that can i change the password on the internet so that he can not access it and if i do that will I be doing anything illegal can he drag me to court for doing that. he is not contributing at all? Please help. This situation is really bothering me. By doing this atleast his girlfriend will leave who does nothing and sits at the apartment all the time watching movies on net and playing music. Please help

    You can change the internet password, it's not illegal.

    But what do you hope to accomplish by that? Hoist yourself up, file an eviction, and get him out of there. What in the world are you afraid of? Filing an eviction isn't a criminal offense.

    I have already offered him to leave without paying any past rent and have offered him help in finding new place as well but he is not listening. So i hope if i stop his internet which he and his girlfriend are hooked to they will leave eventually. Because he will not be able to get another connection in my building there is only one connection available per apartment. Thanks a lot for your help. The reason I am not going to court is because I am on a non immigrant visa in this country and don't understand the law very well and I am afraid that he might hire a lawyer and try to raise some untrue allegation since he has a lot of family here and I have none I wont be able to falsify them.

    I was only wondering that what if he tries to hit me after i change the password. What are my rights and what be the most advisable thing to do? Thank you in advance for helping me.

    He can't "hit you" with anything for changing the password. He's not paying for the service, he's not entitled to use of it.

    Your options are to evict him. Just because you're a visitor, does not mean you have to put up with his crap. Eviction is a pretty simple matter, he doesn't get to drag unrelated parties into it, his family is completely irrelevant.

    I would suggest you consult an attorney for help in getting him out.

    Thank you for all your help, the good news is that my tenant got the court summons and he decided to leave before the court date.

    My question is that tomorrow when he leaves and I return his balance security (after deducting for 15 days of rent) what should I get from him in writing so that he doesn't show up again after the court date has already passed and claim illegal eviction. Also to avoid any further allegations that he may come up with and drag me to court what should i get in writing from him. If anyone can help with the content it would be really helpful. Thanks a lot in advance.

    I would not create any documents. You could leave something out. And it would not be notorized anyway.
