My question involves a roommate in the State of: New York
I have had a roommate since July of 2009. At first she was good. I stupidly didn't have her sign a roommate agreement. Our agreement was rent was due on the 15th of every month, and that her term was 15th-14th of each month.
At the time, she told me she was divorced, and looking to start over.
Fast forward. It turns out she was not divorced, and is currently entangled in a very bitter divorce, one that involved drugs, domestic violence, and other things, and this is spilling over into my life. She works for a sexual services company, and I suspect she brings men over for that reason. She claims it is an escort service. Since December, there have been at least 4-5 different men brought into the apartment at random times.
She has no paid rent since February 15th (and there was a period of time end of last year where she was late as well), nor utilities since last month. I asked her to leave at the end of February. At that time she told me that I have to trust her, because afterall, she could steal all my stuff when I am at work.
After that comment, I started moving many of my personal items, pots, pans, my dishes, television equipment, into my room, as I feel it is ever so slightly more secure in my bedroom than in the public spaces. I continued to ask her for the rent that she was behind on, and politely attempted to assist her in finding a new apartment.
She has now threatened to sue me for harassment because I asked for the rent and is claiming my removing my personal items impedes her enjoyment of the apartment.
Further, she had one of her friends speak to me on the phone to threaten me. I have met the man before, but do not know his last name.
I do not currently feel safe, but I also feel like my hands are tied because of New York's difficulty in removing a roommate or tenant.
Please advise me. I need to get this woman out as quickly as possible, for at the moment, I feel extremely threatened in my own home.
