    Default Bankruptcy and Foreclosure

    My question involves bankruptcy in the state of: Michigan? or South Carolina?

    My situation is this:

    I was laid off in MI and am now well into the foreclosure process. I have since moved to SC. What I would like to know is where i would file, in MI or SC? And being that the foreclosure process is well on its way how should i go about this?

    You would need to have been legally domiciled in South Carolina for 90 days to file there. If you don't meet that requirement, depending upon your contacts with Michigan over the past 180 days you may still be able to file in Michigan. A bankruptcy lawyer can help you sort things out.
