    Default Roomate Never Paid Security Deposit, Though Required - What to Do

    My question involves a roommate in the State of: New York

    Hi,

    I have a roommate who moved in about 4 months ago. He was required to send his security deposit (it's written in the lease) to the landlord when he moved in, and assured me that he did. It turns out he didn't.

    We just got a letter in the mail from the landlord saying that they needed it. He refuses to pay it because it's been so long already.

    What should I do? Can I evict because he didn't follow the rules of the lease? Any other options?

    it sounds like the roommate leases directly to your LL. If so, the dealings are totally between the LL and the roommate.

    You cannot evict unless you were the roommates LL.
