My question involves emancipation laws for the State of: Utah and Montana
I have a friend who is 17 years old, and who was working but had to quit because she had to move to another state, to live with an aunt. Her mother had kicked her out multiple times and would go weeks at a time without even knowing her whereabouts. When she was allowed to stay in her mothers house she was constantly yelled at, in trouble and kicked out for little things such as not washing one of the bowls in the sink, and would loose all phone contacts, so she was unable to call for help to go somewhere if needed. These yelling events usually took place before school and would make it hard for her to focus. Her mothers house was 30 miles from the school she attended as well as her work place and her mother told her to walk or find rides the majority of the time. Her mother is now moving to the same state as her in a few months but has told her daughter she cannot stay with her. The daughter is still in the mothers sole gaurdianship and would like to get emancipated. She has family and friends all willing to let her stay with them and who are all able to provide clothing, food, ext. for her as long as she wishes or until 18. Does she have a way to get emancipated? Or can she have a non family member get gaurdianship over her?
