    Default Marriage of a Foreigner in the States, Changing Status Form Tourist to Permanent

    I have been with my girlfriend for 2 and a half years now here in the Philippines. I am a US citizen currently studying here.

    Our situation is like this:

    Arrive in LA April 20. Have a civil wedding 2-3 days after arrival. File for change of status from tourist to permanent 2-3 days after. Get an interview within 2 months (hopefully before July 1st since I need to attend my last year of my education). When all is said and done, go back to the Philippines and have a church wedding (most of my family is there) a few months before I leave for the states for good. Come back to the states in May 2011 with my wife (at that point I won't be going back to the Philippines due to me graduating).

    What will be hindering our progress with this? I hear the 60 day rule applies, but that is to catch fraudulent marriages? I don't have to mention we are really a couple (we have a bank account, vacation pictures, and other things to prove).

    As has been discussed in dozens of threads in this forum, the issue is that your girlfriend would be committing fraud to enter the U.S. - she would be entering as a tourist, and swearing that she has no intent to immigrate. By lying, she puts herself at risk of being permanently barred from entering the United States. The time frame you're describing would make it pretty obvious that she was lying.

    If you want to risk that, it's your life. I personally would do things the legal way, with a fiancee or spouse visa.
