My question involves unemployment benefits for the state of: CA
I have been on unemployment for about 7 months. I have had problems in past with getting EDD mailings on time.
I have been summoned for a hearing in SF Ofc of Appeals regarding
1. Late appeal, not filed within 20days
2. Does my claim for benefits comply with regulations
Hearing is about an appeal I mailed to EDD about a claim I may have submitted late. Claim was for last two weeks of January.
EDD attempted to hold a "phone interview" on April 13th rag, by calling my home. I was out of town the week of April 7th through 15th. EDD never sent me a notice nor left a message stating their plans to hold the interview. When I returned home, there was a voice message stating that EDD tried to contact me regarding an issue and they would mail me the information. About 3 days later I received an appeal form and 5 claim forms for benefits for the months after the original claim in question. I tried to call EDD 8-10 times during the week of April 16th - 20th with no success but incredibly long waits or dropped calls.
Around April 18th (4 days after attempted phone interview), I received a form to appeal my denied benefits and 5 other claims forms for periods of Feb, March and early April. I filled out the appeal and the forms and mailed them back. Last week I received the notice of the hearing.
I have no idea what, if any, evidence I can bring regarding their failed interview on a Saturday afternoon.
What is likely to be asked of my?
What are my rights to continue my claim?
If I did any temporary, hourly contract work in March which was less than $3,000 do I lose my ongoing benefits?
I've never dealt with unemploment benefits.
