    Default Which Chapter of Bankruptcy to File

    I hope someone here can help me out. My boyfriend lost his house and had a 2nd which is 75,000. Plus he has about 11,000 in other debt. we live together and I was told in California he has to claim my income when doing the means test. Which I feel is unfair cause I did not know they can make other responsible for debts. Can someone clear this up for me. He makes about $42,000 a yr and has full custody of his son and receives no help from the mother. Do you think he could file a chapter 7? Any advise would be great. Thank you

    as far as your income,they wouldnt be trying to make you responsible.they want to see what kind of money is in the bankruptcy estate.if your contributing to everyday living expenses they need to look at that.to see if theres anymoney to pay creditors with out of your boyfriends money.as far as chapters.after the figures are worked the more available free income you have.puts you in a chapter 13.a chapter 7 is a all out bankruptcy where creditors get little if anything.

    If he owes all together about 81,000, I heard they give up to 60 months to pay. There would be no way we could live paying back 1350 a month, if they count my income do they count my bills too. This seems so unfair. Do they count our income before taxes. I am worried. Together before taxes its 6,500 a month, but that sure is not what we take home.

    It would not be 1350 a month where did you come up with that figure, you must speak to a BK lawyer he or she will direct you in the right path to take!

    I have not spoken to a lawyer yet, I did the means test online and it shows that with what bills it allows me we would have around $1350 left to pay back. so i am confused. I dont mind them concidering what half I pay in bills, but to use my income to concider what he is going to pay for bills that are his upsets me. I did not make them. I dont want to live on beans and rice for the next 5 yrs. $74,000 of his debt is from a home he lost.
