    Talking Visa Waiver

    Hi members,

    I and my fiance plan to get married when i go for holidays in LA this summer. I am holding a french passport so I can stay there for 90 days. My questions are :
    Can I change my status being a visa waived holder/ or french passport holder after our marriage and can stay in USA without leaving the country?
    or not, what other options I can take into consideration if I want to stay after our marriage?
    if above won`t work, can I apply for K-3 status and leave USA after filing the papers ? and if yes, how long will it take for me to wait.

    I am presently in Canada on a student permit and lots of questions I was not able to gather answers.

    I really appreciate whatever help and advices you can share me about this matter.

    If you enter on the visa waiver program you can be approved for a stay of up to 90 days, but that does not automatically mean you'll be approved for a 90-day stay.

    If you lie when you enter as a tourist, stating that you have no intent to immigrate, then marry and attempt to adjust your status, you run the risk of being accused of having committed fraud when you entered the U.S. - and fraudulent entry can result in your being permanently barred from the U.S.

    If you marry your fiancé, you and he can apply for a K3 visa after you return home. Your fiancé can also seek a fiancée visa, such that you can enter, marry within 90 days of entry, and then you can adjust your status.
