I recently purchased an acerage in northwest Iowa. It was split off from a family farm and sold to the previous owner, with an easment for the farmer to access the buildings he kept. The property description from the sale reads as follows:
A tract of land in the Southwest Quarter of the Southwest Quarter (SW 1/4 SW 1/4 ) of Section Twenty-three (23) in Township Ninety-foru (94) North of Range Forty (40) West of the 5th P.M., referred to as Parcel A of said SW 1/4, and containing 2.45 acres, more or less, according to the Plat of Daniel Wittrock, PLS, as recorded in the Plat Book 5 on Page 127 ( Inst. #2008-2309); subject to the established highway, and subject to an easement from the roadway abutting the west side of Parcel A across Parcel A in order to access the property and buildings thereon abutting the north, east, and south sides of Parcel A.
Do I have to honor this easment, is there any way I can legally break this easement? If nither of these are an option, am I restricted from building structres on my propety that hinder this easement? Do I have to maintain their access point? or can I let it grow wild hindering their access? I want to eliminate this legally, but am willing to resort to any a@@hole move I can within the law to make it difficult as possible for them to keep using my property.
They still own the land on all sides of the propety - north, south, and east. They are able to build road acess from the highway north or south of my property, just to cheap to do it.
