    Question Can I Sue My Ex for PTSD Due to Abuse and His Cheating

    My question pertains to the state of Illinois.

    I was wondering if it was possible to sue my now ex husband and make him pay for my therapy and RX's. He was abusive and I have been diagnosed w/ PTSD due to abuse from him. (I am familiar w/ Crime Victims Comp) But there was only once that he ended up in county jail for this. The emotional abuse/physical lasted for a total of over 9 months. I was fully cooperative w/ the police and filed for an OP.
    I caught him w/ his girlfriend in my house 10 days after we were married. And the only reason I married him was I believed he would be faithful and would leave her alone..... This guy really messed me up in the head.....
    Any help at all would be useful!!

    You'll have an incredibly hard time getting any jury to award damages for PTSD when you found him cheating after 10 days and stayed with him. Not that it couldn't happen, but the costs for experts and the time involved would only delay any beneficial therapy substantially, which defeats the point. (And if you're still suffering from PTSD, most therapists would strongly advise AGAINST such a persuit for your own mental health). You'd have a much better chance of getting awarded damages for the physical abuse, pain and suffering, loss of income from work, and related items (of course that assumes a win, AND that he has assets that are both discoverable AND attacheable - because winning and collecting are two totally different things).

    It would NOT happen. There simply is no such cause of action.

    You could not prove damages. You can't collect for emotional injury without physical injury.
