My wonderful former employer refused to pay my final expense reports and continue my health insurance (as required by C0BRA). They told their Health Insurance carrier that I had quit, and that I wasn’t eligible.
I did NOT sign any severance agreement.
I filed a complaint with the USDOL, who finally agreed that I was eligible.
- I filed a suit, ProSe, for my expense reports and related costs that I incurred related to this mess.
- The employer turned it over to a Big Law firm, who filed a Motion for Summary Judgment.
- I filed a response to their Motion for Summary Judgment.
- The court has denied their Motion for Summary Judgment.
My questions:
1. Since it seems that I could explain my case in five minutes or less, should I file a Motion for Summary Judgment?
2. Should I contact the Big Law firm, and see whether they want to offer to settle this?
3. Does the court usually schedule the hearing and the trial without any further actions by me?
I’ve contacted a local attorney that wants $150/hour to handle this for me. But these issues seem simple enough for me to handle myself. I don’t want to recover ~$25K, and pay the attorney $30k.
Since the Big Law firm is probably billing $200/hour for their services, it seems that they have no incentive to settle.
Any advice would be appreciated.
