That will depend upon the nature and terms of the diversion program. Diversion programs vary by state, by county, and sometimes also by offense.
Thank you. The terms that were agreed upon was restitution (thats been paid in full), I was on probation (supervised for 2 yrs, and unsupervised the remaining time) and have no other offenses. The attorney in my case is unavailable for me to speak with currently, and to be honest I was quite nervous at the time I signed the agreement and can't remember what he said. My 5 year period will be over on Feb 16, 2011. Will I receive notification if I still cannot get in touch with my attorney? Thanks!
I would expect that, if a court appearance is required, you or your lawyer will receive a notice from the court. If your lawyer remains your counsel of record, the notice may go to him; if not, I would expect it to go to you.
