    Default Assault FV, First Offense

    My question involves criminal law for the state of: Texas

    I walked in on my girlfriend having sex with another man. Besides fighting him, I slapped her. The police responded, but I was gone by then. I have never been arrested before. If or when I get indicted will there be a mandatory drug test?

    If you end up on probation, drug testing may be a condition of your probation.

    Why not try something wild, and lay off the drugs for a while.

    I don't use, it was just a one time thing. I just didn't know if they order a hair test when you're booked. It sounds like that's a no.

    If you appear in the officer's opinion to be intoxicated, it's quite possible to be tested; it's also possible to have testing as a condition of pretrial release if the judge thinks you're using.

    How long does it take for an arrest warrant/capias to be served?
    In my real life experience, either whenever a deputy has time to do so, or if someone calls in that they know where an arrestee is located, or if you are picked up for any other reason.
    In the case I was involved in, the warrant took two months to be served, and I suspect it was only because a neighbor called to inform the police of his whereabouts.

    No, what I mean is I've been checking the city police department's warrant website daily and there is still no warrant. For Assault F/V it seems like they would move faster. I was expecting a 30 day EPO as well. What could be going on?
