    Unhappy 17 Year Old Mother in Texas

    My question involves emancipation laws for the State of: Texas
    I'm a 17-year-old mother, and I have a job, I go to a charter school where I have the chance to graduate early and I am only 4 credits away from graduating. And I plan to continue my education to be come a nurse online.
    But I also plan to get a second job. I pay all my and my son's medical bills and my own cell phone bill along with any other bills that are under my name.

    But I'm living with my parents, and all we ever do is fight and sometimes it has come to a physical level. Also being here I don't have a say in anything that has to do with my son or me. My mom keeps treating me with that if I leave she'll take me and my son who is only a month old off her insurance. I really don’t want my son being in this kind of environment it's just not right. Now I wanted to know if I would have a good chance of getting emancipated, if I put me and my son on Medicaid or should I just wait until November for my 18th birthday?

    Honestly, I'd just wait.

    Because to become emancipated you need to show you are already fully supporting yourself (ie not living with your parents).

    The only reason I'm living with my parents is because my parents said that they would report me as a run away when they found out I was pregnant, and at the time I was only 16. But I am able to support myself and my child.

    But you're not currently doing so - therein lying the problem.

    Texas family code REQUIRES that you're already living apart from your parents.

    And using tax payer programs won't count as "self supporting". The whole point of emancipation is you being able to support yourself AND your child, 100%, with NO help or support. (And realistically, there isn't a court in the country who will emancipate a 17 year old with a child - because you've already SHOWN the court that you are making decisions that don't rise to the level of responsibility the court will demand before even CONSIDERING emancipation).
