Hello, I was charged with agg-assault in december, before I start let me say no one was hurt, or cut in this altercation(but that still dosent make it any better). My boyfriend and I got into a arguement, I pushed him first and I told the police that I pushed him first. He went into the kitchen to fix him something to eat and He warmed up some meat to eat. I followed him into the kitchen and dumped the food in the sink. While all of this is going on we was still fussing, I followed him to the sink with a knife. My intent with the knife was to cut up the meat that I had dumped in sink. While I was doing that attempting to cut the meat up his 13year old daughter came down stairs and saw me holding the knife. she then went up stairs and called her mother who called the police and told them that I pulled a knife on him and the little girl(I know this cause I had the 911 call read back to me). I ended up spending a day in a half in jail, while I was in jail my boyfriend signed all the necessary papers that he didnt want to press charges on me. And for a short time I had a protected order out on me(to where I couldnt harm or threaten him), and now I will be indited on Monday May 8. My question is, for a first time offender in this situation what will normally happen?? I have a lawyer, and he has been around for 15-20 years and he told me that he is not worried that he will get me a lesser charge to where it will probley be probation. I have never been in trouble and my boyfriend is not trying to press charges so what is your legal opion on my situation??? I feel confident that I will not end up doing any jail time. 2 of my other family members have been charged with assault with a deadly wepon and they actually made contact with the other person and they ended up getting their charges dropped / thrown out.
