    Default Establishing Paternity When the Father Lives Abroad

    DFCS attempted to contact my child's father soon after his birth to establish paternity and obtain child support. He lived/lives in the UK. I was never told whether paternity was established, unfortunately. With the distance involved they just dropped the ball and so did I. He never responded to the claims of paternity that I filed. I also contact CSE several years later in attempt to contact him again. I recently discovered where he is again, unfortunately the child is now over 18. What are the chances of recovering the CS at this point? I understand there is no statute of limitations on child support. I know also there is an agreement between CSE in my state and in the country he lives in.

    While the UK will generally enforce a US-originating CS order, you would need to contact an attorney in the UK to get this going.

    Without an order though (which may be the case given that paternity may not have been established) you will not be able to get retroactive child support, or in fact establish an order now the child is over 18.

    I did contact a UK attorney when my son was 5. He sent someone to his parents address to serve him with papers. He visited the parents every weekend and I had his phone number where he resided. The attorney was told he didn't come there anymore(lied) so I doubt he accepted any papers that were served. I didn't have the means to pursue it and CSE who also got involved never got back with me. I recently contacted CSE again to find out what the disposition was. They were going to check the old records and get back in touch which they didn't do either. I just get so angry this "man" is so well to do and my son and I struggled in poverty. It seems there is no justice here.

    I'm so sorry - but there's really not an awful lot you can do. I heavily doubt CSE will give you positive news either.

    The SOL to collect child support once an order has been made may last forever - but without that initial order you just can't collect. If paternity was never established, or if there was never an order for child support, I'm just not seeing any way you can go forward here.

    (fwiw, I'm a Brit ex-pat living in the US - I'm familiar with the law in both countries)

    Just a note to follow up. Thank you for you advise. I was pretty sure I could do nothing but seeing his website sturred up some old emotions. I contacted him by email and blasted him out about the years of neglect of his son. He answered back very apologetic. Too little too late but at least I know he has suffered some guilt and is in some way human. It was never really about the money at this point. My son and I have our apology and will lay it to rest. I had my say and I was heard.
