    Default Giving the Police a False Identity at the Scene of an Accident

    My question involves an injury that occurred in the state of: NY

    My sister was driving without a license when she hit another car. She panicked and gave the police officer my name. I have contacted the police, informing them that it was not me. I didn't tell them that it was her and they haven't gotten back to me yet.

    If this comes back on her, it would be her first offense. Any ideas on what would happen? As angry and hurt that I was that she gave them my name, I don't want anything bad to happen to her or have anything happen that could damage her future. Is there any way that I could, legally, help her out? I'm shaky on this because I don't think I would be the defendant in a case like that--it would be the state, right?

    I'm sorry if I'm missing basic terminology or seem a little disjointed. This has been a very difficult time. Thanks for reading this. I could use any help you can offer right now--I've been pretty distraught.

    *Also, no one was hurt at the scene. Initially, the other party claimed no damage. Since then, they've changed their minds and are looking to be covered by the car owner's insurance. (The car my sister was driving belonged to her boyfriend and she was driving it with his permission.)

    You are technically one of the victims in the case (of identity theft). Your sister, facing criminal charges (along the lines of a charge called "obstruction by disguise", or something similar in your state), would be the defendant in the state's case against her.

    I don't want anything bad to happen to her or have anything happen that could damage her future.
    This isn't in your control. Her choice now pits her against the state (in the form of the DA). She'll have to face that music on her own, with the help of an attorney.

    Don't take the fall for your sister.

    Did she think of you and your future when she lied about her identity?
