    Default How Can a Mother Take the Fathers Name Off of Birth Certificate

    My question involves name change laws in the State of: Mississippi Just found out my grandsons girlfriend (mother of his child) somehow without his knowledge, took his name off of his childs birth certificate and put her name as the childs last name. How can this be done without courts decisions, perternity, letting him know so he could have attained an attorney. Does he not as well as the child (his) have legal rights? He has never agreed to give up his parental rights and is very involved in childs life. Its just they hate each other so she does not let him see the child nor myself the great grandmothe and my daughter the grandmother. Any help in this matter would be greatly appreciated.

    Was he actually on the birth certificate? Has he legally been established as Dad?

    are you saying paternity was not established either with an affidavit of paternity or via a courts decision?

    If not, his name should never have been on the BC.
