    Default Two Charges From a Single Incident

    My question relates to legal practice in the state of: South Dakota

    Sorry, wrong forum. This should be in Criminal Procedure.

    I'm charged with Domestic Simple Assault and Disorderly Conduct. Their both from the same incident. If their both from the same incident isn't it considered one crime? So how can they charge me with two seperate crimes? No affidavits were filed by any party besides the police. It is a common part of plea bargains here for the prosecuter to plea bargain out the smaller charge for a guilty plea to the higher class charge. Seems like some sort of legal railroading to me.
