    Default Roomate Put My Property Outside and Says It Was Stolen

    My question involves criminal law for the state of: ARIZONA

    Here is the gist of the situation I told my roomate i was moving out and the following day she put my property outside in the driveway (approx 30K of electronics, clothing, jewelry, papers etc) I called the police and we went into the apartment some of my things were still there and she hid in the bathroom so i was Not allowed to remove my remaining items. She is claiming that she placed all of my "big ticket items" computer, tv, etc outside and she has no idea what happened. I have a theft report and i am quite positive she has hidden my things at her boyfriends house. I want to persue her on a CRIMINAL charge and hold her responsible for all of this. She is also claiming that items that i saw and police officer saw in the apartment she does not have "anything of mine". This is a matress leather furniture and clothing. I dont know why the police are not holding her responsible and they keep telling me this is a CIVIL matter. It is not this is Criminal and we are talking about serious amounts of money... not a toothbrush.. which is gone also. Please let me know what appropriate charges i can file against her in Arizona. I also do plan to sue her in small claims for at a minimum my insurance deductible. She needs to be held responsible. PS-I was not on the lease but i do have cashed check for rent stating apt number and rent so there is my proof i lived there and witnesses for what i had in the apartment . Please help me this is a nightmare beyond anything...

    that's good she said she put the stuff outside and it was stolen. If you can get her to put that in writing, you then have an admission of her culpability in the loss of your property and ultimately, her liability.


    hope you have some proof of what you had and hopefully receipts.

    actually, you might speak with your insurance company. If they will reimburse you for your losses, they might actually sue her for what they had to pay if they are aware of how the property was lost.

    Since the police don't want to look into this any further, and they are basically right with it being a civil matter, you either drop that or you might consider speaking with the DA. There is a possibility of a couple crimes that may be applicable but it is up to the DA to determine what and if anything is charged, not you.
