    Default Can I Qualify for Unemployment Benefits

    My question involves unemployment benefits for the state of:Georgia

    I've worked for a small business for over 5 years. My brother in Law is the President of the company. We have always had a great relationship. In the past, he told me that if I was ever looking for another job or trying to better my situation, to let him know so that he won't be blindsided. He said that he wanted the best for me and didn't want to give me "golden handcuffs". I am an onsite representative at his biggest account and have had ZERO complaints. EVER. He has recently divorced my sister. Since then, we do not talk much but professionally things remained the same. He sent my boss to ask me if I would be looking for other employment and I told her yes, eventually I would try to find another job. I told her that I understood how important I was to the account so I would give ample notice before I left, up to a month. In the mean time, I worked as I always have, and he hired people to replace me at my job as well as a job that I had been doing to help the customer. He then told me to come to the home office on Monday to start a new position of helping with deliveries and assisting our Marketing person. If i do not accept the position, he will fire me. Will I be able to get unemployment?"

    Maybe, maybe not. I agree that this change would be a "major change in working conditions" that MIGHT qualify you. The problem you have is that, even if you call the state and ask this question, the answer would be "file and we'll make a decision". At that point, you have no job and MAYBE you don't get benefits.

    Thanks so much for replying. I wanted to ask also, If I receive a severance package from him, does that waive any unemployment benefits?

    No, it does not totally, but it might delay them.

    Again, THANKS SO MUCH for your help. I'm learning that this process depends on circumstances and is less black and white than I thought. i spoke with him yesterday and am hoping for a severance of maybe 6 weeks or so. If at the end of that period I am still unemployed and not having any income, I may file a claim. Would you recommend that I file it prior to the expiration of the 6 week period. Is it legal for him to say "I'll give you this severance package (which is atypical at this company) but you must agree to not try to collect unemployment?? THANKS AGAIN for all of your help. You have done so much already, I'd understand if you say enough is enough!

    No, the claim should be filed immediately upon the firing/layoff. Do. Not. Wait. The claim needs to be established ASAP.
