Question Removing a Deviation from Support Forumula Due to Changed Income

    Hello,

A few years back, when I had more money in the bank, I agreed to pay my Ex additional child support. We put in writing etc (legally).

I can no longer afford this amount based on the economy, and the depletion of my assets (savings acct).

I have been paying the support thru my savings acct. mostly.

    Questions:

Am I locked in because I offered and complied with this deviation before?

    or

Is it legal even though agreeing to pay beyond the required amount before to now lower it with a modification of child suport?

I'm curious to know if I'm locked in forever.

    Thx,

    Njb

If there has been a change in circumstance you should file to modify the current child support order.

Child support is like custody - both are fluid, and neither is going to be set in stone forever.

Was this agreement filed with the court and signed by a Judge, making it a modification of the prior order?

Then you need to file for a modification.
