    Default Caught Shoplifting in Ontario

    I would appreciate some feedback in this terrible matter. One week ago I was caught shoplifting at a Wegman's Food Market in Western, New York State. I am an Ontario, Canada resident. No excuse for this behaviour, but let me tell you what happened.

    I am a 48 year old female suffering from extreme depression. I have been on the anti-depressant drug, Effexor for about 4 years. I tried to get off these pills cold turkey last week but got to an all time low. On the day of the shoplifting incident, I took double the usual dose plus drank about 4 glasses of wine. I completely lost my inhibitions and stole items valued at $65.00 which I didn't even want or need. This is my first offence. I have a U.S. lawyer and my date in court is May 15, 2006. What is going to happen to me? If I go to jail, I'll kill myself as I just can't handle this situation. Please help me!

    With no prior record, you're most likely looking at fines, probation, and possibly community service. Your lawyer is the person in the best situation to estimate the outcome of your case.

    I don't see a judge sentencing a first time offender who was intoxicated at the time of the offense to jail for only $65 worth of theft. Like the above post says you're most likely looking at probation/community service and/or fines. They also have a lot of programs you can get into that will lesson the sentence. Ask your lawyer about any programs in your state. I hope you don't look at your intoxicated/depressive state as an excuse or defense. Self induced intoxication does not put you over the law.

    Most states do not allow the arguement that you were drunk at the time of the crime. I know in my state, being intoxicated while in the commission of a crime is another charge altogether...I don't think you should bring up the fact that you were drunk unless they made you take a breathalizer.

    You will most likely get a fine and be ordered to a minimal amount of community service along with 6-12 months of unsupervised probation. Upon the successfull completion, the state will dismiss the charges against you based upon 'compliance'. Your background will show that charges were filed on X/XX/XXXX and dismissed 6- 12 months later..Good luck
