My question involves a roommate in the State of: Illinois.
I am the sole entity on the lease with my landlord, and I have a sublease agreement with my roommate. We reside in a two-unit, owner-occupied building, so the Metropolitan Tenant Ordinance within the Chicago/Cook County area does not apply to our property. (Trust me, I've been doing my research, and because this ordinance is not applicable to my building it has been a PAIN to find accurate information.)
My roommate has been consistently late paying rent--one month he was a week late. I have full documentation of when he has paid rent in the past, including e-mails outlining his refusal to pay on time per the terms of the sublease agreement. His sublease lapses May 31, 2010, and I plan to tell him in the next week (if he doesn't quit avoiding me, that is) that I will not renew his sublease and he must move out by that date. I will be speaking to him in person and also mailing a written notice (overkill, perhaps, but a total CYA move nonetheless).
What are my rights as a sublessor/quasi-landlord if my roommate refuses to pay rent on time or at all in the next two months? How much notice must I give him to vacate for nonpayment of rent, should he decide to stop paying?
