    Unhappy Which State Should I Apply

    My question involves unemployment benefits for the state of: PA,NJ,ME,FL,NC,TN,TX

    Several of my colleagues and I have been working on a project that spans multiple states. This has been a multiple year project and we are considered employees of the company. We have the w-2's and pay stubs to prove employment for 4-6 years.

    Now the project is over and we are trying to apply for unemployment. The problem is since the company taxed us where we were working (not where we live) our taxable income is split among several states. Now the states are denying UI claims or reducing benefits because of this.

    Application has been made in the state we reside NC,TN,TX(reported income = 0.00), the states we worked NJ,PA,FL,GA(not enough time or $$ per state), and PA (the state of the parent Company).

    Not sure what to do now. Which state should be responsible for the UI benefits?

    Thanks for any help anyone can provide.

    You can only have one open claim at any time. You should have applied in your state of residence and listed andy and all of the states to which your employer reported wages.

    Thanks for your replys. So I can only claim with one state at a time. That's what I originally thought but as always when dealing with government there's lots of wrong advice even from their departments. Several have been told to apply with the other states.

    Looks like one of my comrades found someone in PA that is helpful. "I just spoke with the woman from PA UI Office and she said they did file a combined claim for me, the first financial notice is just for PA wages because it has to go out within 48 hours. However, she says to file an appeal form. Then there is a form the Unemployment Office can send to the employer and have them send all wage information."

    Hopefully this will resolve the dillema.

    You have to pick a state and that is where your claim will be for its duration; it's not like you get paid from different states depending on the pro-rata share of your earnings in that state.

    If you don't know where the employer is reporting your earnings, just file in the state in which you live. If that state doesn't have wages for you, they will contact the employer to find out which state does. If ALL your wages have been reported to a single "other" state, that's probably where you'd have to file.
