My offer to purchase a "approved" short sale was accepted 2/23. Selling agent was pushing me to see and move forward on the deal because she had another buyer interested in the property. 2/24 I viewed and accepted the property. 2/25 I received escrow instructions. 3/2 (a)i wire deposit to escrow acct. 3/3 escrow informs me that they have a cancellation notice from seller because I took to long to get money to escrow. My agent received no Notice to Perform and pushes the deal forward. Over the next 2 weeks seller and sellers agent try and cancel at least 5 times stating "this isn't going to work, and they don't like my agent". They have only allowed us to view the property and do an inspection but will not allow us any follow up inspections. 3/15 We give Notice to perform to seller for escrow to close on 3/18. On 3/19 Sellers agent emails the bank cancelled. I think they have had their own buyer on the back this whole time. can I sue them for fraud and breach of contract?
