    Default Statistics on Defamation, Libel

    My question involves defamation in the state of: Various, see below

    Hello all,

    I am doing a bit of research on defamation and libel. I am having trouble locating statistics on the cases. I am looking to see what percentage of cases are brought to trial, how many actually end up in a law suit, settle out of court, etc.

    Of the research I have found, most involve media cases, but usually do not bring up other cases, ie internet, small, mid sized business, individuals, etc. Is this because they are simply too difficult to prosecute, or costly for the small guy? Or is this because they are not published.

    It seems the first amendment plays into defamation/libel in this country. If this is true, are the big differences between a conservative state vs a liberal state? Ie, Mass or NY vs TX.

    Any help or a point in the right direction will be appreciated. Google pointed me into too many directions.

    There are never going to be statistics on perceived cases of libel.

    The only case law is going to be on cases where there was an appeal.

    There are statistics on media wins and losses of cases that get to trial.

    Newspapers are the most likely defendants in a libel case, as libel requires publication. Newspapers are usually local and thus what they say about someone certainly has the most impact and provides a means of establishing some actual damages. Newspapers also have insurance and deep pockets compared to internet publishers.

    There are so many jurisdictional and other issues involved in internet libel and the publishers often have limited assets that these things don't even get to trial.

    I don't know how you could possibly come up with any statistics for anything so nebulous.
