My question involves bankruptcy in the State of: Georgia
(I think I posted this in the wrong forum the first time - sorry)
Hello. I don't know where to start, but we REALLY need help. I am grateful for any guidance as time is of the essence. I tried to meet with an attorney today about bankruptcy consideration, but my VERY important questions went unanswered. One attorney in the practice said we COULD include default judgments in a bankruptcy one said we couldn’t include default judgements.
I reallllllllllly need to know if default judgments can indeed be included in a bankruptcy?
The judgments are the reason we need to file bankruptcy. They have garnished our bank account and safe deposit boxes. There wasn't enough to cover the debt - what can they come after next? (We failed to appear - it was complete ignorance on our part not knowing what would happen.)
We have 2 default judgements. And one writ of fi fa that is about to be defaulted any day. We are trying to stop this.
Thank you in advance for your time and help. I don't know what to do. I also don't know if we should file - but I will wait for a reply to get into why.
My husband lost his job three years ago and I have desparately been trying to keep us afloat. The credit card debt is mostly moving expenses from a company that moved us here from another state then laid my husband off before paying our moving bills. We tried to sue them to pay as we had a contract and they filed bankruptcy. Then I lost 2 pregnancies - one at 16 weeks. Then I was a passenger in a car and we were hit by a 72 year old woman on her cell phone and I was hurt pretty bad. I never went after her at the time. Trying to now to cover all my medical expenses. Reason I am mentioning all this is that in the midst of all this is when we were served with the complaint and we pushed it off. We were dealing with so much else. (Now I know we shouldn't have.)
I don't know what to do. If my husband found another job we could have it all paid off in a year. I don't know if we should file or not.
